The Supreme Court of India has criticised a husband in a divorce plea for recording private conversations with his wife for years and using them as evidence in court.
The husband recorded years of private conversations with his wife using a mobile app. These recordings were submitted as evidence in the divorce case, sparking a debate over their legality and ethical implications.
During the hearing, Justice Nagarathna remarked, “What kind of husband records conversations for so many years?”
The case raises questions about the interplay between the right to privacy under Article 21 of the Constitution and the provisions of the Indian Evidence Act.
The court will examine the applicability of Section 122 of the Indian Evidence Act, which protects communications between married couples. Under this section, a spouse is generally barred from revealing such conversations unless the evidence is submitted in a legal dispute between the spouses
