Maintenance charges by housing societies

Recently Mumbai Court gave a judgement that Cooperative Housing Societies can’t charge maintenance charges from residents based on the size of the flat. It should instead charge on the basis of per flat (irrespective of size of the flat) since common services are equally shared by all residents.

Judgement was given by Justice S K Devkar of Mumbai.

Anybody has the full judgement or citation of the judgement ?

No. The judgement is by the Co-operative Court which does not have a website of its own. One way to get the judgement is by contacting Advocate Abha Singh who appeared in the matter. Her email address is abhasinghlawoffices@gmail.com.

Alternatively, one can contact the Trade World Premises Co-operative Housing Society Limited (the Society involved in the case) which is located at Kamala Mills Compound in Lower Parel, Mumbai.

Thanks a lot.
I shall try contacting Adv Abha Singh ji.
